Civil judge court at Kairana
Establishment of Civil Judge in Kairana was not a one day task, a long struggle was fought under the leadership of Babu Kaushal Prasad Advocate ji (President) Bar Association Kairana . The information we have received from Babuji's collection is this -
On 7th November 1986, Hon'ble Shri Gyan Chand Dwivedi ji (Senior Advocate and Member of Legislative Council) wrote a letter to the then Chief Justice (High Court, Allahabad) Shri KJ Shetty ji. In this letter, Dwivedi ji had mentioned about the meeting with Shri Kaushal Prasad regarding the establishment of Civil Judge Court in Kairana and raising questions regarding this issue in the House.
In the context of this letter, Shri Kaushal Prasad Advocate ji wrote in reply on November 22, 1986 that - Munsifi in Kairana has been established for more than 100 years, not 6 years and also wrote some more questions to ask the Minister of Justice.
कैराना में सिविल जजी की स्थापना कोई एक दिन का कार्य नहीं था, अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी के नेतृत्व में एक लम्बा संघर्ष किया गया. बाबूजी के संग्रह से हमें जितनी जानकारी प्राप्त होती है, वह यह है -22. 11.1986 को बाबूजी ने वरिष्ठ अधिवक्ता और सदस्य विधान परिषद उत्तर प्रदेश श्री ज्ञान चंद्र द्विवेदी जी को उनके पत्र 07.11.1986 के पत्रोत्तर में लिखा जो माननीय श्री ज्ञान चंद्र द्विवेदी जी ने माननीय मुख्य न्यायाधीश उच्च न्यायालय इलाहाबाद श्री के जे शेट्टी जी को लिखा था और जिसमें उन्होंने बाबू कौशल प्रसाद एडवोकेट जी के स्वयं से सिविल जज कोर्ट के लिए मिलने की बात बताई गई थी, साथ ही उन्होंने बताया था कि उन्होंने सदन में कैराना में कोर्ट स्थापना को लेकर प्रश्न भी पूछे थे, जिसके उत्तर में बाबू कौशल प्रसाद एडवोकेट जी ने बताया था कि कैराना में मुंसिफी 6 वर्ष नहीं 100 वर्षों से ज्यादा से स्थापित है और उन्हें न्याय मंत्री से पूछने के लिए कुछ और प्रश्न भी लिखे.
दिनाँक 10.05.1990 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने माननीय सचिव एवं विधि परामर्शी उत्तर प्रदेश शासन, लखनऊ को कैराना जनपद मुजफ्फरनगर में सिविल जज न्यायालय की स्थापना के लिए पत्र लिखा, जिसमें उन्हें यह भी बताया कि वह उनसे सिविल जज न्यायालय के संबंध में 20 मार्च 1990 को लखनऊ में मिले भी थे.
On 09.06.1990, President of Bar Association Kairana Babu Kaushal Prasad Advocate ji again wrote a letter to Hon'ble Shri KL Sharma, Secretary and Legal Advisor, Government of Uttar Pradesh, Lucknow regarding the establishment of Civil Judge Court in Kairana, in which Babuji also told him that about two months back the decision to establish a court of civil judge in Kairana has been taken by the High Court of Allahabad.
On 11.10.1990 President of Bar Association Kairana Babu Kaushal Prasad Advocate ji gave a memorandum for the establishment of Civil Judge Court in Kairana to the Honorable Administrative Judge. In which there was also a demand for the early establishment of the Civil Judge Court as well as the establishment of the Court of Additional Chief Judicial Magistrate and Additional Munsif.
दिनाँक 09.06.1990 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने पुनः माननीय श्री के एल शर्मा, सचिव एवं विधि परामर्शी उत्तर प्रदेश शासन लखनऊ को पुनः कैराना में सिविल जज न्यायालय की स्थापना के सम्बन्ध में पत्र लिखा जिसमें बाबूजी द्वारा उन्हें यह भी बताया गया कि लगभग 2 माह पहले कैराना में सिविल जज का एक न्यायालय स्थापित करने का निर्णय उच्च न्यायालय इलाहाबाद द्वारा लिया जा चुका है.
दिनाँक 11.10.1990 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी द्वारा माननीय प्रशासकीय न्यायाधीश की सेवा में कैराना में सिविल जजी की स्थापना के लिए ज्ञापन दिया गया. जिसमें सिविल जज न्यायालय की शीघ्र स्थापना के साथ साथ अपर मुख्य न्यायिक मजिस्ट्रेट और अतिरिक्त मुंसिफ के न्यायालय की स्थापना की भी मांग की गई.
दिनाँक 22.08.1991 को माननीय मुख्यमंत्री, उत्तर प्रदेश शासन, लखनऊ को कैराना जनपद मुजफ्फरनगर में सिविल जज न्यायालय की स्थापना के सम्बन्ध में पत्र लिखा गया जिसमें अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने बताया कि 16 अप्रैल 1990 को माननीय उच्च न्यायालय इलाहाबाद ने कैराना में सिविल जज का एक न्यायालय स्थापित करने का निर्णय लिया था तथा उत्तर प्रदेश शासन से अनुरोध किया था कि वह उक्त मामले में शीघ्र कार्यवाही करे. उपरोक्त पत्र में बाबूजी ने तत्कालीन उत्तर प्रदेश सरकार के शीघ्र निर्णय की कार्य प्रणाली की भूरि भूरि प्रशंसा की तथा यह अनुरोध किया कि माननीय मुख्यमंत्री उत्तर प्रदेश शासन द्वारा उक्त मामले में शीघ्र निर्णय लेकर कैराना तहसील क्षेत्र की जनता को राम रोटी और इन्साफ की सार्थकता से वास्तविक न्याय प्रदान करें.
The Court of Civil Judge in Kairana was the result of the tireless efforts of Babu Kaushal Prasad Advocate ji. For this, Babuji not only made legal efforts, but also never shied away from political efforts. Babu Kaushal Prasad ji had a good acquaintance with people in the legal and political field but never took any personal advantage, never wrote letters to officials and leaders for any personal work.
On 26 February 1992, Babuji wrote a letter to the Hon'ble Chairman of Municipality Shamli, Shri Rajeshwar Bansal ji for his assistance in establishing the Court of Civil Judge at Kairana and wrote in it - It has been learned from reliable sources that the case of the Court of Civil Judge in Kairana has been approved by the Justice Department of the Government of Uttar Pradesh and has been sent to the Ministry of Finance for further action.
According to the order dated 16 April 1990 of the High Court of Allahabad, the Government of Uttar Pradesh does not have to incur any special expenditure in the establishment of this court because a civil judge has to be transferred from Muzaffarnagar to Kairana of the court and staff.
Therefore, you are requested to make efforts from your level for the establishment of the court of Civil Judge at Kairana soon. ,
कैराना में सिविल जज का न्यायालय अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी के अथक प्रयासों की देन था. इसके लिए बाबूजी ने न केवल कानूनी प्रयास किए, वरन राजनीतिक प्रयासों से भी कभी पीछे नहीं रहे. बहुत अच्छी जान पहचान रखते थे बाबू कौशल प्रसाद एडवोकेट कानूनी और राजनीतिक क्षेत्रों के दिग्गज व्यक्तित्वों से, किन्तु कभी कोई निजी फायदा नहीं उठाया, कभी किसी निजी कार्य के लिए अधिकारियों और नेताओं को पत्र नहीं लिखा. दिनाँक 26 फरवरी 1992 को बाबूजी ने अध्यक्ष नगरपालिका शामली श्री राजेश्वर बंसल जी को कैराना में सिविल जज के न्यायालय की स्थापना में सहायता के लिए पत्र लिखा और उसमें लिखा -
" विश्वस्त सूत्रों से ज्ञात हुआ है कि कैराना में सिविल जज के न्यायालय का मामला उत्तर प्रदेश शासन के न्याय विभाग से स्वीकृत हो गया है तथा वित्त मंत्रालय को आगामी कार्यवाही के लिए भेज दिया गया है. उच्च न्यायालय इलाहाबाद के आदेश दिनाँक 16 अप्रैल सन 1990 के अनुसार इस न्यायालय की स्थापना में उत्तर प्रदेश शासन को कोई विशेष व्यय नहीं करना है क्योंकि मुजफ्फरनगर से एक सिविल जज का न्यायालय मय स्टाफ के कैराना हस्तांतरित होना है.
अतः आपसे निवेदन है कि सिविल जज कैराना का न्यायालय शीघ्र स्थापित कराने के लिए आप अपने स्तर से प्रयास करें. "
On 01.07.1992 the letter of the then MLA Kairana Chaudhary Munavvar Hasan received by the President of Bar Association Kairana Babu Kaushal Prasad Advocate ji and in which he has asked him to meet the District Judge and send a reply to the Secretary of Justice, then President of Bar Association Kairana Babu Kaushal Prasad Advocate ji informed On 15.07.1992 to Shri Krishna Bihari Shukla, Joint Secretary Justice Section-1, in regarding to the establishment of Civil Judge Court in Kairana and states that this proposal is under consideration before the Government of Uttar Pradesh from 16.04.1990.
and according to the order of Allahabad High Court dated 16.04.1990, the Government of Uttar Pradesh does not have to incur any new expenditure for the establishment of the said court, writing this, Babuji demanded once again to provide cheap, accessible and speedy justice to the litigants from Justice Department .
01.07.1992 को तत्कालीन विधायक कैराना चौधरी मुनव्वर हसन का पत्र अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी के पास आता है और जिसमें उन्हें जल्द जिला जज से मिलकर न्याय सचिव के पास ज़वाब भिजवाने के लिए कहा जाता है तब अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी 15.07.1992 को श्री कृष्ण बिहारी शुक्ला, संयुक्त सचिव न्याय अनुभाग -1 को सिविल जज न्यायालय की कैराना में स्थापना के सम्बन्ध में बताते हैं कि यह प्रस्ताव 16.04.1990 से उत्तर प्रदेश शासन के समक्ष विचाराधीन है तथा इलाहाबाद उच्च न्यायालय के दिनाँक 16.04.1990 के आदेश के अनुसार उत्तर प्रदेश शासन को कोई नया व्यय भी उक्त न्यायालय की स्थापना के लिए नहीं करना है, यह लिखते हुए बाबूजी ने न्याय विभाग से वादकारियों को सस्ता, सुलभ और शीघ्र न्याय उपलब्ध कराने की एक बार फिर मांग की.
On 03.10.1992 President Bar Association Kairana Babu Kaushal Prasad Advocate ji wrote a letter to Hon'ble Registrar Sir, High Court Allahabad regarding the appointment of Civil Judge Kairana and amendment in the appointment of Munsif Kairana, from which it is known that the Uttar Pradesh Government through its Justice Department, established a court of Civil Judge at Kairana by issuing notification No. 2504/VII-Nyaya - 2 - 714/86 dated 20.08.1992. In the letter, Babuji informed the High Court and the Registrar Sir about the gratitude expressed by the Bar Association Kairana and requested for the immediate appointment of Civil Judge Kairana.
दिनाँक 03.10.1992 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने सिविल जज कैराना की नियुक्ति के लिए और मुंसिफ कैराना की नियुक्ति में संशोधन के संबंध में माननीय रजिस्ट्रार महोदय, उच्च न्यायालय इलाहाबाद को पत्र लिखा, जिससे ज्ञात होता है कि उत्तर प्रदेश शासन ने अपने न्याय विभाग के द्वारा अधिसूचना संख्या 2504/VII-Nyaya - 2 - 714/86 दिनाँक 20.08.1992 जारी करके कैराना में सिविल जज का एक न्यायालय स्थापित किया. पत्र में बाबूजी ने उच्च न्यायालय व रजिस्ट्रार महोदय को बार संघ कैराना द्वारा आभार व्यक्त करने की सूचना दी और सिविल जज कैराना की तुरंत नियुक्ति किए जाने के लिए अनुरोध किया.
दिनाँक 21.11.1992 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने सिविल जज कैराना की नियुक्ति व मुंसिफ मजिस्ट्रेट कैराना को आर्थिक अपराधों की शक्तियां प्रदान करने के संबंध में माननीय रजिस्ट्रार महोदय उच्च न्यायालय इलाहाबाद को पत्र लिखा, जिससे पता चलता है कि उत्तर प्रदेश शासन द्वारा कैराना में सिविल जज के न्यायालय की स्थापना के लिए न्याय विभाग द्वारा दिनाँक 20 अगस्त 1992 व वित्त सम्बन्धी आदेश दिनाँक 20. 10.1992 को जारी किए जा चुके थे, अब केवल उच्च न्यायालय द्वारा सिविल जज कैराना के नाम की घोषणा होनी शेष थी.
On 30.12.1992 President of Bar Association Kairana Babu Kaushal Prasad Advocate ji expressed his gratitude to Hon'ble Justice Shri M.P. Singh Administrative Judge, High Court Allahabad for establishing the Court of Civil Judge at Kairana from written a letter on his personal letter pad and expected blessings and good wishes for Kairana.
दिनाँक 30.12.1992 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने अपने निजी लेटर पैड से कैराना में सिविल जज के न्यायालय की स्थापना के लिए माननीय न्यायमूर्ति श्री एम. पी. सिंह प्रशासनिक न्यायाधीश उच्च न्यायालय इलाहाबाद का आभार व्यक्त किया और उनसे बार संघ कैराना के लिए आशीर्वाद और शुभ कामनाओं की अपेक्षा की.
And then on 04 January 1993, with the continuous efforts of Bar Association Kairana through its President Babu Kaushal Prasad Advocate ji, the inauguration of the Court of Civil Judge in Kairana was completed by the blessed hands of the Honorable District Judge Mr Dinesh Chandra Srivastava Muzaffarnagar in the presence of high judicial officers of the district and the work of Civil Judge started in Kairana.
और फिर 04 जनवरी 1993 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी के प्रयासों से कैराना में सिविल जज के न्यायालय का माननीय श्री दिनेश चंद्र श्रीवास्तव जनपद न्यायाधीश मुजफ्फरनगर के कर कमलों से जनपद के उच्च न्यायिक अधिकारियों की मौजूदगी में उद्घाटन सम्पन्न हुआ और कैराना में सिविल जजी का कार्य आरंभ हो गया.
