बार एसोसिएशन का बार काउंसिल ऑफ उत्तर प्रदेश से संबद्ध

   The President of Bar Association Kairana Babu Kaushal Prasad Advocate ji was very aware about the interests of the advocates and thus he kept on taking his steps forward for the interests of the advocates. In 1989, Babuji took his steps forward to get the Bar Association Kairana affiliated with the Bar Council of Uttar Pradesh. From the collection of Babu Kaushal Prasad Advocate ji, we get this letter written in the name of the then President of Bar Council of Uttar Pradesh Shri Jagdish Pathak ji, in which Babuji had written that -"Your letter dated 14th May 1989 has been received, according to the above letter, I have sent the necessary documents to get the Bar Association Kairana affiliated with the Bar Council of Uttar Pradesh along with a bank draft of Rs 100/- to the Secretary, Bar Council of Uttar Pradesh, Allahabad on 24.06.1989. You are requested to take necessary action to get the Bar Association Kairana affiliated with the Bar Council at the earliest.

अधिवक्ताओं के हितों को लेकर अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी बहुत जागरूक थे और येन केन प्रकारेण वे अधिवक्ताओं के हितों को लेकर अपने कदम आगे बढ़ाते ही रहते थे. 1989 में बाबूजी ने बार एसोसिएशन कैराना को बार काउंसिल ऑफ उत्तर प्रदेश से संबद्ध कराए जाने हेतु अपने कदम आगे बढ़ाए. बाबू कौशल प्रसाद एडवोकेट जी के संग्रह से हमें तत्कालीन अध्यक्ष बार काउंसिल ऑफ उत्तर प्रदेश श्री जगदीश पाठक जी के नाम लिखा यह पत्र प्राप्त होता है जिसमें बाबूजी लिखते हैं कि -

" आपका दिनाँक 14 मई 1989 का पत्र प्राप्त हुआ, उक्त पत्र के अनुसार मैंने बार एसोसिएशन कैराना को बार काउंसिल उत्तर प्रदेश से संबद्ध कराने के लिए आवश्यक कागजात 100/- रुपये के बैंक ड्राफ़्ट सहित सचिव, बार काउंसिल ऑफ उत्तर प्रदेश, इलाहाबाद को दिनाँक 24.06.1989 को भेज दिये हैं. आपसे अनुरोध है कि बार एसोसिएशन कैराना को शीघ्र ही बार काउंसिल से संबद्ध कराने के लिए आवश्यक कार्यवाही करें. "

 

 On 14 May 1989, the letter sent by the President of Bar Council of Uttar Pradesh Dr Jagdish Kishore Pathak, was received by the President of Bar Association Kairana, in which it was told that the Uttar Pradesh Advocates Provident Fund Scheme Rules 1989, dated 14 May 1989 has come into force. Under which every advocate becoming a member of the provident fund scheme will be entitled to receive an amount of Rs.1,000/- every year as a fund and for this, every Bar Association of Uttar Pradesh was asked for immediate affiliation with the Bar Council of Uttar Pradesh so that the members of each Bar Association can get the benefit of Advocate Provident Fund Scheme. Seeing the interest of the advocates, President of Bar Association Kairana Babu Kaushal Prasad Advocate ji made efforts for this and with his efforts Bar Association Kairana, Muzaffarnagar was affiliated to Bar Council of Uttar Pradesh and the advocates of Bar Association Kairana got the status of respected advocates in the state of Uttar Pradesh and since then the advocates of Bar Association Kairana also started getting the benefit of Advocate Provident Fund Scheme. Bar Association Kairana received certificate of affiliation from Bar Council of Uttar Pradesh on 8 July 1989. 

 14 मई 1989 को अध्यक्ष बार काउंसिल ऑफ उत्तर प्रदेश डॉ जगदीश किशोर पाठक जी का जो पत्र अध्यक्ष बार एसोसिएशन कैराना को प्राप्त हुआ था उसमें बताया गया था कि उत्तर प्रदेश अधिवक्ता भविष्य निधि योजना नियमावली 1989, दिनाँक 14 मई 1989 से लागू हो गयी है जिसके अंतर्गत प्रत्येक अधिवक्ता भविष्य निधि योजना का सदस्य बनने पर 1,000/-रुपये की धनराशि प्रत्येक वर्ष निधि के रूप में प्राप्त करने का अधिकारी होगा और इसके लिए उत्तर प्रदेश की प्रत्येक बार एसोसिएशन से बार काउंसिल ऑफ उत्तर प्रदेश से तत्काल संबद्धता के लिए कहा गया ताकि प्रत्येक बार एसोसिएशन के सदस्यों को अधिवक्ता भविष्य निधि योजना का लाभ मिल सके और तब अधिवक्ताओं का हित देखते हुए अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने इसके लिए प्रयास किए और उनके प्रयासों से बार एसोसिएशन कैराना, मुजफ्फरनगर बार काउंसिल ऑफ उत्तर प्रदेश से संबद्ध की गई और बार एसोसिएशन कैराना के अधिवक्ताओं को उत्तर प्रदेश राज्य में सम्मानित अधिवक्ताओं का दर्जा प्राप्त हुआ और तब से बार एसोसिएशन कैराना के अधिवक्ताओं को अधिवक्ता भविष्य निधि योजना का लाभ मिलना भी आरंभ हुआ. बार एसोसिएशन कैराना को बार काउंसिल ऑफ उत्तर प्रदेश से संबद्धीकरण का प्रमाणपत्र 8 जुलाई 1989 को प्राप्त हुआ.

  Affiliation of Bar Association Kairana with Bar Council of Uttar Pradesh was done under Rules 1979 and affiliation number of Bar Association Kairana is 37...../89.

By the letter dated 13.07.1989, Hon'ble Secretary of Bar Council of Uttar Pradesh, Shri Harikrishna Agrawal, has informed to the President of Bar Association Kairana that the said affiliation is valid for the next 5 years and the end of the fifth year will be considered till 31st July.

बार एसोसिएशन कैराना का बार काउंसिल ऑफ उत्तर प्रदेश से संबद्धीकरण नियम 1979 के अंतर्गत किया गया था तथा बार एसोसिएशन कैराना की संबद्धीकरण संख्या 37...../89 है ।

बार काउंसिल ऑफ उत्तर प्रदेश के माननीय सचिव श्री हरिकृष्ण अग्रवाल के  पत्र दिनाँक 13.07.1989 के द्वारा अध्यक्ष बार एसोसिएशन कैराना को यह सूचित किया गया कि उक्त संबद्धीकरण आगामी 5 वर्षों हेतु वैध है तथा पांचवे वर्ष की समाप्ति 31 जुलाई तक मानी जाएगी ।

Babuji was very conscious about the interests of the advocates of Bar Association Kairana and after observing the validity period 1993 in the affiliation certificate, Babu Kaushal Prasad Advocate ji wrote in a letter dated 07.07.1993 to Hon'ble Shri Harikrishna Agrawal Secretary Bar Council of Uttar Pradesh -

" That the Bar Association Kairana had got affiliation with the Bar Council of Uttar Pradesh in 1989

 and through the letter sent by you it was informed that this affiliation is for 5 years, but in the certificate (serial number 241) on 31 July As of 1993 this affiliation has been written as valid - which is wrong. This date should be 31 July 1994 because 5 years are completed in July 1994."

  बार एसोसिएशन कैराना के अधिवक्ताओं के हितों को लेकर बाबूजी बहुत सचेत थे और संबद्धीकरण प्रमाण पत्र में वैधता अवधि 1993 लिखे जाने पर बाबू कौशल प्रसाद एडवोकेट जी ने हरिकृष्ण अग्रवाल सचिव बार काउंसिल ऑफ उत्तर प्रदेश के नाम दिनाँक 07.07.1993 को पत्र में लिखा -

" कि बार एसोसिएशन कैराना ने 1989 में बार काउंसिल ऑफ उत्तर प्रदेश से संबद्धीकरण कराया था तथा आपके द्वारा भेजे गए पत्र के द्वारा यह सूचित किया गया था कि यह संबद्धीकरण 5 वर्ष के लिए है, परंतु प्रमाण पत्र ( क्रम संख्या 241) में प्रमाण पत्र के 31 जुलाई 1993 तक विधि मान्य लिखा गया है - जो गलत है. यह दिनाँक 31 जुलाई 1994 होनी चाहिए क्योंकि 5 वर्ष जुलाई 1994 में पूरे होते हैं। "

 

 The administrative functions of the Bar Association are very complex and it is not in the hands of the ordinary personality to do these works perfectly . President of Bar Association Kairana Babu Kaushal Prasad Advocate ji, in view of the interest of the advocates, got the Bar Association Kairana affiliated with the Bar Council of Uttar Pradesh, but it was not done merely by sending only a few rupees or sending information to the office bearers, the Bar Association is not affiliated with the Bar Council of Uttar Pradesh

 Rather, the mistake of marking the validity period in the certificate by the Bar Council of Uttar Pradesh was rectified by Babuji after taking cognizance, then after applying for re-affiliation with the Bar Council of Uttar Pradesh on completion of the validity period after five years, dated on 05.11.1994 Babu ji was informed by the Secretary, Bar Council of Uttar Pradesh to renew the society registration and send its certified copy. Without renewal of society registration is not possible.

 बार एसोसिएशन के प्रशासनिक कार्य बहुत जटिलता भरे हुए होते हैं और उनसे पार पाना साधारण व्यक्तित्व के वश में नहीं होता है, अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने अधिवक्ताओं का हित देखते हुए बार एसोसिएशन कैराना को बार काउंसिल ऑफ उत्तर प्रदेश से संबद्ध कराया किन्तु मात्र कुछ रुपये भेजना या पदाधिकारी गण की सूचना भेजने मात्र से बार एसोसिएशन बार काउंसिल ऑफ उत्तर प्रदेश से संबद्ध नहीं हो गई वरन कभी बार काउंसिल ऑफ उत्तर प्रदेश द्वारा प्रमाण पत्र में वैधता अवधि अंकित करने की त्रुटि को बाबूजी द्वारा संज्ञान लेकर ठीक कराया गया तो पांच वर्ष के बाद वैधता अवधि पूर्ण होने पर बार काउंसिल ऑफ उत्तर प्रदेश से पुनः संबद्धीकरण का आवेदन करने पर 05.11.1994 को सचिव, बार काउंसिल ऑफ उत्तर प्रदेश द्वारा सूचित किया गया कि सोसाइटी रजिस्ट्रीकरण को नवीनीकृत कराकर उसकी प्रमाणित प्रतिलिपि भेजें.  बिना सोसायटी रजिस्ट्रीकरण के नवीनीकरण के सम्भव नहीं है.

 

Then President of Bar Association Kairana Babu Kaushal Prasad Advocate Ji had written a letter to the Secretary, Bar Council of Uttar Pradesh on 29.06. 1994 , in which he tried to draw the attention  to the rule written in the letter dated 14 May 1989 of the President of the Bar Council of Uttar Pradesh, it was written that -

 "  "The process of the Societies Registration Act has become very complicated, so in view of this difficulty, the Bar Council in its meeting dated 14th May 1989 has decided that those Bar Associations will also be affiliated to the Uttar Pradesh Bar Council which is presently a society. have not been registered under the Registration Act.

 And with this, wrote a letter to the President Bar Council of Uttar Pradesh Shri Jagdish Sirohi Advocate ji and wrote the same fact and urged him to make arrangements to send the renewal certificate to the Bar Association Kairana immediately.

तब अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने दिनाँक 29.06. 1994 को पत्र लिखकर उनका ध्यान दिनाँक 14 मई 1989 के अध्यक्ष बार काउंसिल ऑफ उत्तर प्रदेश के पत्र में लिखे नियम की ओर आकर्षित किया, जिसमें लिखा था कि -

" सोसाइटी रजिस्ट्रेशन अधिनियम की प्रक्रिया बहुत जटिल हो गई है इसलिए इस कठिनाई को देखते हुए बार काउंसिल ने अपनी दिनाँक 14 मई 1989 की बैठक में यह निश्चय किया है कि उन बार एसोसिएशनों को भी उत्तर प्रदेश बार काउंसिल से संबद्ध कर लिया जाएगा जो फ़िलहाल सोसायटी रजिस्ट्रेशन अधिनियम के अंतर्गत पंजीकृत नहीं हो पाए हैं. 

और इसी के साथ एक पत्र अध्यक्ष बार काउंसिल ऑफ उत्तर प्रदेश श्री जगदीश सिरोही एडवोकेट जी को लिखा और यही तथ्य लिखकर बार एसोसिएशन कैराना को नवीनीकरण प्रमाण पत्र तुरंत भिजवाने की व्यवस्था करने का आग्रह किया. 

 

 On 16.04.1999, President of Bar Association Kairana Babu Kaushal Prasad Advocate ji wrote a letter regarding renewal of certificate of affiliation 37/89 of Bar Association Kairana and gave him the list of office bearers of the Bar Association, the list of members of the Bar Association along with the attested copy of the certificate of the Bar Association under the Society Registration Act , a bank draft of Rs 100/- was also sent to the Secretary of the Bar Council of Uttar Pradesh, Allahabad. From this collection of babu Kaushal Prasad  Advocate ji we got information that he had also fulfilled the demand of society registration in affiliation of Bar Association by Bar Council of Uttar Pradesh so that the member advocates of Bar Association can be accepted by Bar Council of Uttar Pradesh and the member advocates would be able to get all the facilities provided by the Bar Council of Uttar Pradesh . The number of the certificate of society registration  is  1045 /1998-99 of the Bar Association Kairana  and was signed by the Registrar of the Society, Uttar Pradesh on 09.03.1999.

दिनाँक 16.04.1999 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने बार एसोसिएशन कैराना के संबद्धता प्रमाणपत्र 37/89 के नवीनीकरण के सम्बन्ध में पत्र लिखा और उन्हें बार एसोसिएशन के पदाधिकारियों की सूची, बार एसोसिएशन के सदस्यों की सूची और साथ में सोसाइटी रजिस्ट्रेशन अधिनियम के अंतर्गत बार एसोसिएशन के प्रमाण पत्र की सत्यापित कॉपी के साथ सचिव बार काउंसिल ऑफ उत्तर प्रदेश इलाहाबाद के नाम 100/-रुपये का बैंक ड्राफ़्ट भी भेजा. बाबू कौशल प्रसाद एडवोकेट जी के इसी संग्रह से हमें यह जानकारी प्राप्त हुई कि उन्होंने बार काउंसिल ऑफ उत्तर प्रदेश द्वारा बार एसोसिएशन की संबद्धता में सोसाइटी रजिस्ट्रेशन की मांग को भी पूरा किया था ताकि बार एसोसिएशन के सदस्य अधिवक्ताओं को बार काउंसिल ऑफ उत्तर प्रदेश के द्वारा प्रदान की जाने वाली सभी सुविधाएं प्राप्त हो सकें. सोसाइटी रजिस्ट्रीकरण के प्रमाण पत्र पर बार एसोसिएशन कैराना की संख्या 1045 सन 1998-99 है और इस पर सोसाइटी के रजिस्ट्रार उत्तर प्रदेश द्वारा 09.03.1999 को हस्ताक्षर किए गए. 

Bar Association Kairana was affiliated with the Bar Council of Uttar Pradesh through the efforts of Babu Kaushal Prasad Advocate ji and after affiliating it, Advocates in Kairana also benefited from the schemes of Bar Council of Uttar Pradesh due to the efforts of Babuji. The history of the Bar Association Kairana is that when  Babuji became its President, it was Babuji who make it possible for Bar Association Kairana to take benefits  from the Bar Council of Uttar Pradesh and when he had not presided , then he had himself filled Bar Council of Uttar Pradesh  application form  for renewal of affiliation of the Advocates Association with the Bar Council.

On 01.11.2012, President of Bar Association Kairana Babu Kaushal Prasad Advocate ji wrote a letter to the Secretary, Bar Council of Uttar Pradesh, in which he informed him that the renewal of affiliation of Bar Association Kairana was done till 31.07.2009 and after that till 2014 the office bearers of Bar Association Kairana could not get the renewal done due to some reason , so necessary records and bank draft of Rs.200/- is being sent now and all the necessary documents for affiliation were sent by Babu ji through Kuldeep Singhal Advocate and the Bar Association was affiliated till 2018 and thus he performed his duty towards the advocates even after his death.

बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी के प्रयासों से बार काउंसिल ऑफ उत्तर प्रदेश से जुड़ी और इससे जुड़ने के बाद बाबूजी के प्रयासों से कैराना में अधिवक्ता बार काउंसिल ऑफ उत्तर प्रदेश की योजनाओं से लाभान्वित भी हुए और बार एसोसिएशन का इतिहास यह रहा कि जब जब बाबूजी इसके अध्यक्ष हुए तब बाबूजी ने ही इसे बार काउंसिल ऑफ उत्तर प्रदेश से लाभ दिलाए और जब अध्यक्ष नहीं रहे तब स्वयं बार काउंसिल ऑफ उत्तर प्रदेश के बार काउंसिल से अधिवक्ता संघ के संबद्धन के नवीनीकरण हेतु आवेदन पत्र - प्रारूप  भरकर दिए.

    दिनाँक 01.11.2012 को अध्यक्ष बार एसोसिएशन कैराना बाबू कौशल प्रसाद एडवोकेट जी ने श्रीमान सचिव महोदय बार काउंसिल ऑफ उत्तर प्रदेश के नाम एक पत्र लिखा, जिसमें उन्होंने बताया कि बार एसोसिएशन कैराना के संबद्धीकरण का नवीनीकरण दिनाँक 31.07.2009 तक हो चुका था और उसके बाद 2014 तक बार एसोसिएशन कैराना के पदाधिकारी गण नहीं करा पाए, अतः आवश्यक अभिलेख और 200 /-रुपये का बैंक ड्राफ़्ट भेजा जा रहा है.

      और संबद्धता हेतु सभी आवश्यक दस्तावेज बाबू जी ने कुलदीप सिंघल एडवोकेट से भिजवाए और बार एसोसिएशन का 2018 तक का संबद्धीकरण करा गए और इस तरह अधिवक्ताओं के प्रति अपने कर्तव्य को अपनी मृत्यु के बाद भी निभा गए.
